EXCEPT AS EXPRESSLY PROVIDED IN SEPARATE SERVICE AGREEMENTS, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RWA HORIZONS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
Our total liability for any claims arising out of or related to these Terms or our services shall not exceed the amount paid by you to us in the twelve (12) months preceding the claim.
You agree to indemnify, defend, and hold harmless RWA HORIZONS LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of your use of our services or violation of these Terms.
We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice. Upon termination, your right to use our services will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for intellectual property matters.
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms, together with any separate service agreements, constitute the entire agreement between you and RWA HORIZONS LLC regarding the use of our services.
